Use of the App

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

Your Account

• You are responsible for maintaining the security of your account
• You are responsible for all activity that occurs under your account
• You must provide accurate information when creating an account
• You must notify us immediately of any unauthorized use of your account

Guest Usage

You may browse events, save events locally to your device, and use the map without creating an account. Certain features (event submission, following venues, push notifications, preferences) require an account.

Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Post false, misleading, or fraudulent event information
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the App or its systems
• Use automated means to access the App without our permission
• Interfere with or disrupt the App's functionality
• Submit spam events or use the submission system for advertising unrelated to local events

Content

Event Information

The App displays event information from various sources including venue partners, community submissions, and admin curation. We strive for accuracy but do not guarantee that all event details are current or correct. Always verify event details with the venue or organizer.

User Content

You retain ownership of content you submit to the App. By submitting content (including event submissions and venue information), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the App.

Event Submissions

Events submitted by users are subject to review and approval by our team. We reserve the right to reject, edit, or remove any submitted event at our discretion.

Business Accounts

Venue Claims

Business owners may request to claim their venue listing. Claims are subject to verification and approval by our admin team. We reserve the right to approve or reject any claim.

Business Responsibilities

Business account holders agree to:

• Provide accurate venue and event information
• Keep their venue listing current
• Use the platform in accordance with these Terms
• Not misrepresent their business or events

Promoted Events

Promoted event placements are subject to availability and our content guidelines. Payment for promoted placements is processed through Stripe. Refund policies for promoted events will be communicated at the time of purchase.

Intellectual Property

The App and its original content, features, and functionality are owned by GoingOn and are protected by copyright, trademark, and other intellectual property laws.

Disclaimers

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure.

We are not responsible for:

• The accuracy of event information displayed in the App
• Any transactions or interactions between you and event organizers or venues
• Any loss or damage resulting from your use of the App
• The actions or content of business account holders or venue partners

Limitation of Liability

To the maximum extent permitted by law, GoingOn shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

Changes to the App and Terms

We reserve the right to:

• Modify or discontinue the App at any time
• Update these Terms at any time

We will notify you of material changes to these Terms. Continued use of the App after changes constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately. Business account features and any active promoted events will be deactivated.

Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles.
